Terms and Conditions

Welcome to Swing It USA LLC (“Company,” “we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your access to and use of our golf simulator facility, website, services, memberships, events, and related offerings (collectively, the “Services”).

By entering our facility, using our simulators, purchasing a membership, booking a session, or accessing our website, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

1. Eligibility

  • You must be at least 18 years old to use the Services independently.

  • Minors must be accompanied by a parent or legal guardian, who assumes full responsibility for the minor’s conduct and safety.

2. Facility Rules and Conduct

  • Proper golf etiquette and respectful behavior are required at all times.

  • Swing It USA LLC reserves the right to refuse service or remove any individual for unsafe behavior, misconduct, intoxication, or violation of these Terms.

  • Outside food and beverages are permitted.

3. Use of Golf Simulators

  • Use of golf simulators involves inherent risks, including but not limited to physical injury or property damage.

  • Users must follow all posted instructions and staff guidance.

  • Only approved golf clubs and balls may be used.

  • Swing It USA LLC is not responsible for damage to personal equipment.

4. Assumption of Risk and Waiver of Liability

By using our Services, you acknowledge and agree that:
 

  • You voluntarily assume all risks associated with participation, including personal injury, illness, or property damage.

  • Swing It USA LLC, its owners, employees, contractors, and affiliates shall not be liable for any injuries, losses, or damages arising from the use of the facility or equipment, except where prohibited by law.

  • You agree to release and hold harmless Swing It USA LLC from any claims arising from your participation.

5. Memberships

  • Membership tiers may include Social, Premier, Club, Corporate, each with specific benefits and limitations.

  • Membership benefits are non-transferable unless expressly stated.

  • Membership fees are billed according to the selected plan and are non-refundable, except as required by law.

  • Swing It USA LLC reserves the right to modify membership benefits, pricing, or structure with reasonable notice.

6. Bookings, Payments, and Cancellations

  • All bookings are subject to availability.

  • Payment is required at the time of booking unless otherwise specified.

  • Cancellation and rescheduling policies will be communicated at the time of booking and may vary by service.

  • No-shows may be charged in full.

7. Events and Private Functions

  • Deposits may be required for private events or group bookings.

  • Event-specific terms, including minimum spend and cancellation policies, may apply.

  • The booking party is responsible for all guests and any damage caused during the event.

8. Photography, Video, and Marketing

  • By entering the facility, you consent to being photographed or recorded for promotional and marketing purposes unless you notify staff in writing.

  • All content created by Swing It USA LLC remains the property of the Company.

9. Intellectual Property

  • All logos, trademarks, website content, simulator software, and materials are the property of Swing It USA LLC or its licensors.

  • Unauthorized use, reproduction, or distribution is strictly prohibited.

10. Privacy

  • Your personal information will be handled in accordance with our Privacy Policy.

  • We do not sell personal data to third parties.

11. Limitation of Liability

To the fullest extent permitted by law, Swing It USA LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of the Services.

12. Indemnification

You agree to indemnify and hold harmless Swing It USA LLC from any claims, damages, or expenses arising from your violation of these Terms or misuse of the Services.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to conflict of law principles.

14. Changes to Terms

Swing It USA LLC reserves the right to update or modify these Terms at any time. Continued use of the Services following any changes constitutes acceptance of the revised Terms.
